Welcome to Prosper Health. This website (the “Site”) is owned and operated by Prosper Health, Inc. (“Prosper Health,” “we,” or “us”), a technology and administrative services company. These Terms of Use (“Terms”) govern your access to and use of the Site and any non-clinical services offered through it.
By using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Who We Are
Prosper Health, Inc. provides administrative and technology infrastructure to support behavioral health care. Clinical services are provided exclusively by licensed professionals affiliated with Prosper Health Medical Services, P.C. (or equivalent state-registered entities), a separate professional corporation.Nothing on this Site constitutes medical advice or creates a provider–patient relationship. All medical care is delivered by Prosper Health Medical Services. See our Informed Consent for more information.
2. Eligibility and Account Use
You must be 18 years or older to use this Site. If you are using it on behalf of a minor, you must be their legal guardian.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Acceptable Use
You agree not to:
- Use the Site for unlawful, fraudulent, or abusive purposes
- Attempt to gain unauthorized access to our systems
- Use automated systems (bots, scrapers, etc.) to access the Site without permission
- Interfere with or disrupt the Site’s functionality
We may suspend or terminate your access at our sole discretion for violation of these Terms.
4. Payments and Billing
Use of some services may require payment. If you engage in clinical services through Prosper Health Medical Services, you will be bound by the financial terms in our Informed Consent, including authorization to store and charge your payment method on file.
Prosper Health uses third-party processors for billing. We do not store your full credit card information.
5. No Warranties
The Site is provided “as is” and “as available,” without warranties of any kind. We do not guarantee the Site will be uninterrupted, error-free, or free from viruses.
We make no guarantees regarding the outcomes of services accessed through the Site.
6. Limitation of Liability
To the maximum extent allowed by law, Prosper Health is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. Our total liability is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose.
7. Intellectual Property
All content on the Site—including text, graphics, logos, and software—is owned by Prosper Health or its licensors and protected under applicable law. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.
8. Privacy
Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and protect your data. Any protected health information (PHI) is governed by our Privacy Policy.
9. Communication Consent
By using the Site, you consent to be contacted by us via email, SMS, or phone for administrative purposes, including account support and billing. For clinical communication policies, refer to the Informed Consent.
10. Dispute Resolution
These Terms are governed by the laws of the State of Delaware. Any disputes will be resolved through binding arbitration on an individual basis in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action or jury trial.
You may opt out of arbitration within 30 days of accepting these Terms by emailing help@prosperhealth.io with “Arbitration Opt-Out” in the subject line.
11. Modifications
We may update these Terms at any time. Changes will be posted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
